Terms of Service

Welcome to FlashAttend. These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between the purchasing or utilizing organization/institution ("Client," "User," "you") and the founders of FlashAttend, Rudra Prasad Sahu and Noothan Gude ("we," "our," "us").
By creating an administrative account, deploying our local PC software, or using our mobile application, you agree to comply with and be bound by these Terms. If you do not agree, you must immediately cease all use of our software.
1. Description of Services
FlashAttend provides automated, AI-powered attendance verification software via two distinct models:
- The Mobile Application (
#smartphone-terms): Uses smartphone cameras to process facial landmarks locally and sync secure, mathematical data tokens to a cloud environment. - The PC-Based CCTV Solution (
#cctv-terms): Processes local institutional CCTV RTSP streams entirely on-premise on the Client's hardware to mark attendance.
2. Free Trial and Billing Terms
A. One-Month Free Trial
We offer new institutional Clients a one (1) month free trial evaluation period to test the system platform. Upon the expiration of the one-month trial period, continued access to data synchronization, cloud token verification, and administrative dashboard logs requires a paid service license.
B. Manual Invoicing and Payment
- Payment Method: All software licenses are billed via professional manual invoices issued by us. Payments must be settled via direct bank transfer (NEFT, IMPS) or via official business UPI QR code as detailed on the invoice.
- Suspension for Non-Payment: Payments are due within the timeframe specified on your invoice. If an institution fails to clear an invoice within seven (7) calendar days of its due date, we reserve the right to immediately suspend cloud backend synchronization and forcefully sign out all administrative and institutional accounts from the mobile app and local interfaces, entirely blocking access to the system and preventing new entries from being logged until the balance is cleared in full.
3. Accuracy and "No-Proxy" Disclaimer (AI Performance)
FlashAttend uses advanced computer vision algorithms to convert facial landmarks into mathematical vector tokens. However, facial verification accuracy is inherently dependent on external environmental factors.
Limitation of Liability: FlashAttend is an administrative efficiency tool designed to assist with attendance logging. We do not warrant or guarantee 100% mathematical accuracy under all operational conditions.
We are not legally or financially liable for any administrative errors, missed logging windows, or proxy attempts (such as a user attempting to bypass the system with static images or videos) resulting from improper setup, poor camera lighting, obscured angles, or client-side tampering. Final validation of attendance logs remains the sole responsibility of the Client's designated administrators.
4. Platform Hardware & Network Responsibilities
A. Smartphone App Model
The Client is entirely responsible for securing the physical mobile devices used to run the app. It is the Client's duty to prevent unauthorized individuals from accessing administrative interfaces or registration features on those devices.
B. On-Premise CCTV Model
Because the PC-based CCTV solution runs completely on-premise inside your facility:
- The Client is 100% responsible for providing and maintaining the physical computer hardware, local area network, and processing power required to run the local matching software.
- The Client must maintain and secure their own local CCTV cameras and camera stream feeds (RTSP). We are not responsible for software crashes or processing delays caused by deficient computer hardware, poor network bandwidth, or interrupted RTSP feeds.
5. Mandatory Legal Compliance & Biometric Consent
In compliance with Section 43A of the Indian Information Technology Act and the Digital Personal Data Protection (DPDP) Act, facial biometric patterns are classified as personal data.
- Client Responsibility: The Client (the school, university, or corporate enterprise) acts as the primary collector of data. You explicitly agree that you have obtained prior, verifiable, written consent from your staff, students, or their respective legal parents/guardians before registering their facial profiles into the FlashAttend platform.
- Indemnification: You agree to fully indemnify and hold harmless Rudra Prasad Sahu and Noothan Gude against any legal claims, penalties, or damages arising from your failure to secure proper third-party consents before processing biometric features.
6. Termination of Service
You can choose to stop using FlashAttend at any time. Upon termination, administrators can permanently wipe all institutional records and mathematical facial tokens directly from the mobile interface, instantly removing their data footprint from our cloud VPS environment.
7. Governing Law and Legal Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or in connection with FlashAttend shall be subject to the exclusive jurisdiction of the courts located in Berhampur, Odisha.
