Welcome to FlashAttend. These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between the purchasing or utilizing organization/institution ("Client," "User," "you") and the founders of FlashAttend, Rudra Prasad Sahu and Noothan Gude ("we," "our," "us").

By creating an administrative account, deploying our local PC software, or using our mobile application, you agree to comply with and be bound by these Terms. If you do not agree, you must immediately cease all use of our software.

2. Free Trial and Billing Terms

A. One-Month Free Trial

We offer new institutional Clients a one (1) month free trial evaluation period to test the system platform. Upon the expiration of the one-month trial period, continued access to data synchronization, cloud token verification, and administrative dashboard logs requires a paid service license.

3. Accuracy and "No-Proxy" Disclaimer (AI Performance)

FlashAttend uses advanced computer vision algorithms to convert facial landmarks into mathematical vector tokens. However, facial verification accuracy is inherently dependent on external environmental factors.

Limitation of Liability: FlashAttend is an administrative efficiency tool designed to assist with attendance logging. We do not warrant or guarantee 100% mathematical accuracy under all operational conditions.

We are not legally or financially liable for any administrative errors, missed logging windows, or proxy attempts (such as a user attempting to bypass the system with static images or videos) resulting from improper setup, poor camera lighting, obscured angles, or client-side tampering. Final validation of attendance logs remains the sole responsibility of the Client's designated administrators.

4. Platform Hardware & Network Responsibilities

A. Smartphone App Model

The Client is entirely responsible for securing the physical mobile devices used to run the app. It is the Client's duty to prevent unauthorized individuals from accessing administrative interfaces or registration features on those devices.

B. On-Premise CCTV Model

Because the PC-based CCTV solution runs completely on-premise inside your facility:

5. Mandatory Legal Compliance & Biometric Consent

In compliance with Section 43A of the Indian Information Technology Act and the Digital Personal Data Protection (DPDP) Act, facial biometric patterns are classified as personal data.

6. Termination of Service

You can choose to stop using FlashAttend at any time. Upon termination, administrators can permanently wipe all institutional records and mathematical facial tokens directly from the mobile interface, instantly removing their data footprint from our cloud VPS environment.

7. Governing Law and Legal Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or in connection with FlashAttend shall be subject to the exclusive jurisdiction of the courts located in Berhampur, Odisha.
